Contracts shall be awarded based on price and other factors including but not limited to experience, education, and special accreditations. The Borough reserves the right to reject any and all proposals and to waive any immaterial informality as may be permitted by law. The due date for all bid submissions has been changed from June 27, 2024 to July 18, 2024 at 10:00 a.m. Sealed bids will now be received by Borough of Seaside Park, Seaside Park County, New Jersey on or before July 18, 2024, at 10:00 a.m., prevailing time, at Borough of Seaside Park Municipal Clerk’s office, 1701 N. 3. BID DOCUMENTS
The bid must be returned in its entirety in order to be considered for an award. Each bid must be accompanied by the items requested below in the form(s) attached. Failure to provide these items and the entire bid package may cause for rejecting this proposal. Consent of Surety will not be required of existing tenants.
2. PROJECT SPECIFICATIONS
5. The minimum bid is sixty-five thousand and 00/100 dollars ($65,000.00) a year to be paid in equal monthly installments. Rental payments shall commence on the first day of the month after bid award, whichever occurs first(the “Rent Commencement Date”). An extension of the Rent Commencement Date limit may be granted by the Borough if there is a delay in obtaining necessary approvals which is beyond the control of successful bidder and/or if the Borough deems successful bidder is making a good faith effort to obtain necessary approvals.
The phrase “ whichever occurs first” shall be deleted from paragraph 5 of the instructions to bidders.
13. Successful bidder(s) agree to pay Borough reasonable fees for the engineering review of Plans associated with the installation of Successful bidder’s equipment, in an amount not to exceed TEN THOUSAND and NO/100 Dollars ($10,000), upon reasonable proof of same. This provision is not required of existing tenants unless modifications of existing equipment are proposed at the time of bid submission.

NOTICE OF PUBLIC AUCTION OF REAL ESTATE LOCATED AT 66 I STREET, BLOCK 57, LOT 2 OF THE BOROUGH OF SEASIDE PARK, COUNTY OF OCEAN
PLEASE TAKE NOTICE that pursuant to N.J.S.A. 40A:12-13 et seq., the Borough of Seaside Park has authorized the sale of Block 57, Lot 2, via public auction to the highest bidder. The property shall be sold at public auction on Tuesday, May 14, 2024 at 10:00 a.m. in the second floor Council Chambers, located at Sixth & Central Avenues, Seaside Park, NJ 08752.
The premises will be sold subject to Federal, State and Municipal Laws and Regulations including applicable ordinances, easements, conditions, restrictions and rights of way of record and such facts as an accurate survey may disclose. The Property to be sold is a vacant conforming lot without any capital improvements described as follows:
Block 57, Lot 2; 66 I Street, – Minimum Bid $550,000.00
The successful bidder shall deposit either cash or a bank check, a deposit equal to ten (10%) percent of minimum price of the bid at time of bidding, with the balance to be paid by either cash or bank check at closing. The sale of the Property is being made subject to the terms, conditions, restrictions and limitations of a Contract of Sale, including but not limited to the following terms and conditions:
- The Property is being sold in an “AS IS” condition. The successful bidder is responsible for conducting any and all inspections and testing of the Property at its own cost and expense. The Property is sold subject to any and all conditions.
- The property shall not be used for any purpose other than single-family residential purposes. The term “residential purposes” excludes hospitals, clinics, duplex houses, apartment houses, boarding houses, hotel, commercial and professional uses. No building shall be erected, altered, placed or permitted to be constructed on this lot other than a single family residential home constructed in accordance with Borough Ordinances.
- Should the Property be developed, it shall be done in accordance with all applicable Borough Ordinances as well as County and State laws, rules and regulations.
- The deed must be recorded within thirty (30) days of closing or title to the Property shall automatically revert back to the Borough of Seaside Park without the necessity of entry or reentry.
- With respect to the sale of the Property herein, no real estate commission is owed.
- The deed given by the Borough of Seaside Park for the Property will be a Quit Claim Deed. No title contingencies or conditions are permitted.
- The Borough reserves the right to accept the highest responsive bid if equal to or greater than the minimum bid price, or to reject all and not to award to the highest bidder. The Borough reserves the right to waive any and all defects and informalities in any proposal, and to accept or reject the highest responsible and responsive bid deemed to be in the best interest of the Borough.
- The sale shall be subject to other terms and conditions contained in a Contract for Sale of Real Estate, a form of which shall be forwarded to the purchaser by the Borough Attorney. Failure to execute the Contract shall not affect the obligation of the successful bidder or the validity of the sale.
- The successful bidder shall pay an additional $550.00 which shall constitute the cost of preparation and Attorney’s review and approval of the documents, as well as the cost of recording the Deed with the Ocean County Clerk.
- The description and location of the land is for information purposes only, and prospective bidders should examine the Property prior to bidding to verify this information.
- Borough of Seaside Park shall not be responsible for the costs associated with any title/last owner or lien searches in the event the Borough of Seaside Park is unable to convey title and/or if a bid is rejected.

NOTICE TO BIDDERS
A NOTICE IS HEREBY GIVEN that sealed Bid Packets will be received by the Municipal Clerk for the Borough of Seaside Park, County of Ocean, State of New Jersey on April 16, 2024, at 10:00 AM prevailing time at the Borough of Seaside Park, Municipal Building, located at 1701 N. Ocean Avenue, Seaside Park, NJ 08752 at which time and place the Bid Packets will be publicly unsealed and its contents announced in public for FY2022 NJDOT Municipal Aid Road Program – Improvements to South Bayview Avenue Phase I – FY2023 NJDOT Municipal Aid Road Program – Improvements to South Bayview Avenue Phase II.
The scope of Work contemplated for the abovenamed project includes roadway milling, grading, and paving; storm drainage improvements; driveway, sidewalk, and curb reconstruction; SESC; roadway striping; and yard restoration as well as all other work of any type or description necessary for contemplation of the Project, whether or not specifically described in these Contract Documents. All Work on this Contract shall be completed within Seventy-five (75) Calendar Days from Notice to Proceed. Bidders are advised, no construction improvements are permitted to begin for this project until Tuesday, September 3, 2024. The issuance date of the Notice to Proceed will be based on the September 3, 2024, start date.
Contract Documents and Plans for the proposed work, which have been prepared by Stephen Schreiber, PE, of the firm of T&M Associates, are available at the T&M Associates Office, 1144 Hooper Avenue, Suite 202, Toms River, New Jersey 08753, and may be inspected by prospective Bidders during business hours 8:30am – 4:30pm. Bidders will be furnished with a copy of the Contract Documents upon proper notice and payment of a nonrefundable charge of Fifty Dollars ($50.00) payable to “T&M Associates” (Toms River Office) to defray the cost thereof.
The provided Bid Packet must be completed in the manner designated in the Contract Documents, must be enclosed in a sealed envelope bearing the name and address of the Bidder and the name of the Project on the outside and must be addressed to the Borough of Seaside Park, Jenna Jankowski, Municipal Clerk. Also, Bid Packets must be accompanied by a Statement of Consent of Surety from a surety company holding a Certificate of Authorization to do business in the State of New Jersey and either a Bid Bond or a Certified Check drawn to the order of “Borough of Seaside Park” for not less than ten percent (10%) of the total bid price amount, except that the check shall not exceed $20,000.00. The successful Bidder is hereby notified that a Performance and Payment Bonds for the full amount of this Project is required.
The award of the Contract for this Project will not be made unless and until the necessary funds have been provided by Borough of Seaside Park in a lawful manner. Please be advised that this Project is being funded through the Borough of Seaside Park. By virtue of Executive Order #34 (1976), vendors currently suspended, debarred or disqualified are excluded from participating on this Project.
The successful Bidder shall be required to comply with the applicable statutory requirements of the Contract Documents and Plans which include all of the following: (i) N.J.A.C. 17:27; (ii) N.J.S.A. 10:5-31 et seq.; (iii) Business Registrations (N.J.S.A. 52:32-44); (iv) Prevailing Wage Act (N.J.S.A. 34:11-56.25, et seq.); (v) Public Work Contractor Registration (N.J.S.A. 34:11-56.48); and (vi) Affirmative Action Requirements (N.J.S.A. 10:5-1, et seq.); and any other legal requirements applicable to this Project.
The Borough of Seaside Park intends to award this Project to the lowest responsible and responsive Bidder in accordance with applicable law. The Borough of Seaside Park reserves the right to reject any and all Bid Packets to the extent permitted by law. The Borough of Seaside Park, a municipal corporation (hereinafter “the Borough”) is accepting written proposals for services for a real estate firm to provide brokerage and marketing services for a commercial property 66 I Street, Block 57, Lot 2, Seaside Park, New Jersey, that is owned by the Borough of Seaside Park.
The Borough reserves the right to accept or reject any or all proposals in whole or in part and to waive any informality the Borough may determine is necessary. The Borough also reserves to itself the exclusive right to accept any proposals when it is deemed by the Borough to be in its best interest.
In awarding any proposal, the Borough may consider, but not be limited to, any of the following factors: cost, professional qualifications, experience, and references. The Borough may hold interviews with the broker agency and broker/realtor prior to making a decision.

The Scope of Work contemplated for the above named project includes location, disconnect and abandonment of all existing utilities serving the buildings, asbestos abatement, lead base paint management, universal waste management, demolition and disposal of existing buildings, pool, signs, walls, concrete/asphalt walkways/parking areas and general surface restoration as well as all other Work of any type or description necessary for contemplation of the Project, whether or not specifically described in these Contract Documents. Each bid shall be accompanied by a certified check, cashier’s check or bid bond duly executed by the bidder as principal and having as surety thereon a surety company approved by the Borough Of Seaside Park in an amount not less than ten percent (10%) but in no case in excess of $20,000.00 of the amount bid. The award of the contract shall be made subject to the necessary moneys to do the work being provided by the Borough Of Seaside Park in a lawful manner. The contract to be executed by the successful bidder will provide that it shall not become effective until the necessary moneys to do the work have been provided by the Borough Of Seaside Park in a lawful manner. The award shall further be subjected to the securing of necessary State, Federal or Local permits governing the work.

A N O T I C E I S H E RE B Y G I V E N that sealed Bid Packets will be received by the Municipal Clerk for the Borough of Seaside Park, County of Ocean, State of New Jersey on October 18, 2023, at 10:00 AM prevailing time at the Borough of Seaside Park, Municipal Building, located at 1701 N. Ocean Avenue, Seaside Park, NJ 08752 at which time and place the Bid Packets will be publicly unsealed and its contents announced in public for FY2023 CDBG Accessibility Improvements to the J Street Recreation Center.
The Scope of Work contemplated for the above named project includes interior building barrier free bathroom improvements, kitchen cabinets, counter top, undermount sink, flooring improvements, plumbing and electrical improvements, exterior site work consisting of a ADA compliant ramp, landing, and handrails, concrete ADA parking stall and loading area, regulatory signs, bollards, and site grading as well as all other Work of any type or description necessary for contemplation of the Project, whether or not specifically described in these Contract Documents. All Work on this Contract shall be completed within ninety (90) Calendar Days from Notice to Proceed.
Contract Documents and Plans for the proposed work, which have been prepared by Stephen Schreiber, PE, of the firm of T&M Associates, and architectural drawings have been prepared TM Architects and are available at the Seaside Park Borough Hall, 1701 N Ocean Avenue, Seaside Park, NJ, 08752 and may be inspected by prospective Bidders during business hours 8:00am – 4:00pm.
Bidders will be furnished with a copy of the Contract Documents upon proper notice and payment of a non-refundable charge of Fifty Dollars ($50.00) payable to “T&M Associates” (Toms River Office) to defray the cost thereof.
The provided Bid Packet must be completed in the manner designated in the Contract Documents, must be enclosed in a sealed envelope bearing the name and address of the Bidder and the name of the Project on the outside and must be addressed to the Borough of Seaside Park, Sandra F. Martin, Municipal Clerk. Also, Bid Packets must be accompanied by a Statement of Consent of Surety from a surety company holding a Certificate of Authorization to do business in the State of New Jersey and either a Bid Bond or a Certified Check drawn to the order of “Borough of Seaside Park” for not less than ten percent (10%) of the total bid price amount, except that the check shall not exceed $20,000.00. By virtue of Executive Order #34 (1976), vendors currently suspended, debarred or disqualified are excluded from participating on this Project.

PLEASE TAKE NOTICE that pursuant to N.J.S.A. 40A:12-13 et seq., the Borough of Seaside Park has authorized the sale of Block 57, Lot 2, via public auction. A person bidding on a contract for the erection, alteration or repair of a public building, structure, facility or other improvement to real property, the total price of which exceeds $100,000, shall furnish a guarantee as provided for herein. A contracting unit may provide that a person bidding on any other contract, advertised in accordance with law, shall furnish a guarantee as provided for herein. This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10.
The project is funded in part by the New Jersey Environmental Infrastructure Trust and the successful bidder must comply with all provisions of N.J.A.C. 7:22-9 et seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SEDs). This invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization requirements. The agencies specified in N.J.A.C. 7:22-9.13(a)8 will have a list of eligible SED firms and shall, upon request, provide them to the MUNICIPAL CORPORATION. The MUNICIPAL CORPORATION, during the bidding phase, will provide copies of the list to all Contractors on unrestricted contracts.
Contractor shall be required to comply with the Project Plan developed by the Borough Of Seaside Park fulfilling the SED utilization. All prime Contractors will be required to submit a SED Utilization Plan to the Borough Of Seaside Park and the NJDEP Office of Equal Opportunity and Public Contract Assistance no later than thirty (30) days after notification that they are the low bidder. The Contractor shall award no less than ten (10) percent of the total amount of all contracts for building, materials, equipment or services for the project to SED’s.

All iron and steel products used in this project must be produced in the United States.
